Job Description and Duties:

The Department of Industrial Relations Office of the Director Legal Unit is hiring for two senior-level Attorney IV positions. Attorneys in this position are responsible for a wide variety of complex and interesting work, both non-litigation and litigation, broadly within the area of labor and employment law.

Under the general direction of the Chief Counsel of the Office of the Director Legal Unit (OD Legal) and the Assistant Chief Counsels, Attorney IV's represent the Director of the Department of Industrial Relations (DIR), the Department, and division chiefs and managers in a variety of subject areas within the responsibility and jurisdiction of the Department. Responsibilities include, among others, representing the Director of DIR in a special type of complex workers’ compensation cases involving trust funds administered by the Director (SIBTF, UEBTF and DWD), representing the Department in internal DIR personnel, discipline and other labor and employment matters, serving as hearing officers in prevailing wage and other types of cases, and providing legal advice and representation in public works, Public Records Act, privacy, contracts, and other subject areas.

Attorney IVs also serve as primary and/or in-house counsel in civil litigation, including complex civil writ litigation, analyze pending legislation, draft and/or comment on proposed regulations, and advise Department leadership on a wide variety of policy questions. Attorney IV's are expected to have a high level of knowledge, skill, and expertise as practicing attorneys. Assignments will involve dealing with complex, novel and sensitive issues, and will require strong analytical, communication and writing skills, sound judgment, and the ability to work with opposing counsel, stakeholders, and other external representatives who also have a high level of experience, expertise and skills.

Essential functions of this position are to perform competently as a senior-level attorney in the specific job duties identified in the Duty Statement (which should be reviewed before applying!); to accomplish assigned legal work with a minimum of supervision and exercising broad discretion, while also taking and following general direction from the Chief Counsel and Assistant Chief Counsels; to communicate effectively both orally and in writing, as required for the specific job duties, including by producing high quality legal briefs and other written work product; to appear in workers' compensation, civil and administrative courts as necessary and as assigned; to communicate in a professional, respectful and productive manner with judges, opposing counsel, Department leadership, stakeholders, colleagues, and the public; to travel as necessary and as assigned; and to demonstrate good judgment and act with high ethical standards. The ability to travel for a short duration (one to two days) is required for this position.

The office is located on the 7th floor in a high-rise office building at:1515 Clay Street, Oakland, California.

This is a full-time position. Employees in this position are required to work extensively on computers as necessary for the drafting of letters, briefs, and other documents, and for research, email communication, file review, training, and other purposes. Extensive use of the telephone and video conferencing are also required. Attorneys are expected to handle their own word processing, and secretarial support is generally limited to the finalization and filing process.

Following the probationary period, regular telework may be considered, in consultation with the supervisor, although work days in the office will also be required. Attorneys are eligible to work up to three days per week at home, at least two days per week of work in the office is required. This is not a full-time telework position.

This position requires occasional in-state travel, either locally within Northern California, or for one or two-night overnight trips within California, based on assignments, and as determined according to the needs of the Department.
